It depends of the rules. By positional superko, you are right, by
situational superko you are not. In Japanese rules, Black can recapture and
kill Black.
Similar problems can be constructed for situational superko.

Still, these problems can be efficiently solved simply by setting a flag on
all situations in the current line of play (see my previous post).
